This T-Shirt will Get You Suspended

If you’re going to school in West Virginia and want to get suspended, this is the shirt to wear.

The mother of a teenager who was arrested for wearing an NRA t-shirt to his West Virginia middle school is suing the Logan County Board of Education.

Tanya Lardieri filed the lawsuit in federal court on behalf of her son, Jared Marcum, who was 14 at the time of the incident.

Marcum was told by a teacher to turn the shirt inside out. When he refused, he was ordered to the principal’s office, where he refused a second time.

Police charged him with disrupting an educational process and obstructing an officer. The charges were dismissed, but the school still forced him to serve a one-day suspension.

The family is seeking $200,000 in compensatory damages and $250,000 in punitive damages for alleged violations of Marcum’s First and Fourteenth Amendment rights.

“What was this kid’s real injury?” Arthur Aidala asked on “Outnumbered” today. “Was there a half-million dollars in injuries to this kid? A half a million?”

“There’s no case. There’s no damages.”

Kirsten Powers acknowledged that there may not be hundreds of thousands of dollars in damages, but Marcum’s free speech was impinged upon.
