A 16-year-old boy from York, Pennsylvania, who was charged with criminal homicide admitted to shooting a 50-year-old man last week but said he did so in self-defense.
Bernard Simmons III was charged as an adult after he was arrested at his school Tuesday. The shooting, part of which was captured on surveillance video, occurred outside of a business on Monday, April 3, around 8:40 p.m.
Authorities say the video shows what appears to be Craig Henise, 50, talking with two people for about 15 minutes, before the two individuals walked out of view of the camera and shots were fired. Witnesses say they heard around a dozen gunshots. Henise was shot in the leg where the bullet struck his femoral artery. He later died at a local hospital.
Simmons, in the presence of his mother, was subsequently interviewed by investigators. The teen, who gave the gun to a friend after the altercation, admitted to the shooting but said he feared for his safety after seeing what he believed was a gun tucked away in Henise’s waistband. However, police have not said whether a second gun was recovered.
In addition to homicide, Simmons was also charged with carrying a firearm without a license.
