Newly released security video shows the exchange between two neighbors outside of their Indianapolis homes last month that ended in gunfire.
Johnson County Prosecutor Brad Cooper determined last week that Dean Keller, 49, will not face charges for shooting Jeffrey Weigle, 59, four times.
While the video shows Weigle raise a handgun, which seemingly justifies Keller’s response, Cooper clarified he based his decision on state law as opposed to the escalating circumstances.
“The decision to not file charges on Keller was a simple application of Indiana law and should not be looked upon as condoning the behavior of either party,” Cooper said.
Authorities say the two men had lengthy and ongoing disputes that stemmed from dogs, motorcycles, and fence locations, among other things. But the disputes came to a head on June 27 as Weigle sat on a riding lawnmower and the two men exchanged insults.
Cooper said Weigle was the aggressor in that particular instance. “It was reasonable for Keller to believe deadly force was necessary to prevent serious bodily injury to himself (and) his wife,” he said.
Weigle remains in the hospital. Cooper said charges against Weigle “will be determined if and when he recovers.”
