“What’s been lost in the debate is the fact that Republicans have an alternative to the Democratic proposal.” weeklystandard.com reveals. “Under Republican legislation sponsored by Senator John Cornyn, the federal government may delay the sale of a firearm to someone on the watch list for up to 72 hours. During that time, if the government can show a judge there’s ‘probable cause’–the same legal standard used to obtain a search warrant–that the individual is plotting terrorism, then the gun sale is denied outright.” Wait. What? That still means . . .

No due process! The prohibited buyer has no ability to confront his accuser. Make his case. Defend his rights. And what’s the bet that the “compromise” legislation contains the same secrecy clause – the government is allowed to exclude evidence it considers sensitive in its submission to the judge – as the original “terrorist loophole” bill.

And what happens if the prohibited person wants to appeal the decision? And if the aspiring gun buyer is plotting terrorism, why the hell is he on the streets?

    So if the government doesn’t want you own a firearm it simply places you on the “No Fly List.” And now the Republicans have agreed that the evidentiary standard required to revoke an American citizen’s Constitutional rights is “probable cause”? That, my friends, is treason.

    Prepare for Veterans, ex-police officers, NRA members, Tea Party members, Christians, Pro-Life Groups, and any other conservative group you can imagine, to be placed on the “No Fly List.”
