Proposed MI Law Does Not Protect Women and Can Unfairly Target Innocent Gun Owners


I had an opportunity to chime in on the debate about a proposed system to disarm bad guys suspected of having a mental illness. Most of the commentary I shared was not used. However, my concerns about due process of the accused were aired in the story. Overall, I do not support this bill. I believe that it can be used to punish those who have been unfairly accused.

Current law allows for a PPO to be ordered ex parte to an alleged victim of domestic violence. The net effect grants the accused a hearing within 14 days that does not exist in this newly proposed legislation. The accused has to petition the court to get a hearing. Also, current law allows a person with a PPO to get an Emergency CPL immediately to protect himself against an intimate partner accused of abuse.
Moreover, under current law, a person with a PPO can’t own or possess a firearm or have a CPL.
Legislation needs to be looked at that gives folks with suspected mental issues the treatment they need. Currently, they can be arrested, if warranted, and held for observation …Read the Rest
