Democrat Tries to Bully Supreme Court into Inaction on Oppressive Gun Control Ordinance

A Democratic Party Senator lashed out at the U.S. Supreme Court Monday in hopes of backing the court away from ruling on an oppressive gun control law that New York City wished to implement.

Sen. Sheldon Whitehouse (D-RI) filed a legal brief that attempted to bully the Supreme Court to dismiss a challenge, New York City Rifle and Pistol Association v. New York City, to a New York City gun transportation regulation.

“The Supreme Court is not well. And the people know it. Perhaps the Court can heal itself before the public demands it be ‘restructured in order to reduce the influence of politics,’” Whitehouse wrote, threatening ‘court-packing’ which has gained traction in extremist Democrat circles. “Particularly on the urgent issue of gun control, a nation desperately needs it to heal.”

The regulation, now clawed-back, originally forbade the transportation of firearms anywhere in the city except to and from a gun range. The ordinance also made it illegal to move firearms out of the city. It’s also the last thing this nation needs in order “to heal.”

The plaintiffs in the case argue that it made it impossible for them to take firearms with them to vacation homes for self-defense and to competitions outside the city – an obvious infringement on their right to bear arms.

A district and 2nd Circuit judge both upheld New York City’s unconstitutional ban, but the city amended the ordinance when the NRA appealed to the U.S. Supreme Court. Now, fearing a Heller-like loss in the nation’s top court, anti-gun progressives are hoping to prevent the highest legal authority in the land from ruling on the premise.

Should the court rule against NYC in this case, it would create a significant obstacle against the creation of similar, ridiculous regulations and Democrats aren’t up for that fight. So, as spoiled brats are oft to do, they turn to threats – idle though they may be.

“Court-packing” as Sen. Whitehouse threatened, is the idea that if the Supreme Court is balanced unfavorably against the current top political party, that party could expand the court and nominate more justices in-line with their ideology. Basically, Democrats are telling the court that if they don’t do what the Democrats demand, there will be retribution. Of course, first, Democrats would have to retake the Senate.

The U.S. Supreme Court must act as an independent and co-equal branch. Even the idea of Sen. Whitehouse’s threat should embolden the court to take up this gun case and rule decisively in favor of the plaintiffs.
